1. Parties and platform

These Terms govern use of Bazako.com, operated by Billion Peoples Technologies, a partnership firm, at www.bazako.com. The marketplace facilitates transactions between customers and participating sellers, except where an order/product page expressly identifies another seller structure.

2. Acceptance

By using the website/app or placing an order, the user agrees to these Terms, applicable policies and order-specific conditions. If the user does not agree, they should not use the service.

3. Marketplace model

Bazako.com may provide listing, discovery, payments/checkout integration, logistics coordination, customer support, grievance handling and other technology services. Seller obligations and product responsibilities remain with the seller to the extent allocated by law and contract. Actual legal status depends on operations; these Terms do not attempt to contract out of statutory duties that cannot lawfully be excluded.

4. Seller representations

Seller represents that it has the right to sell the product, owns or lawfully uses relevant IP, provides truthful product information, complies with category laws, holds required licences/certifications, follows tax obligations and honours lawful consumer remedies.

5. Product information

Product images, dimensions, colour, specifications and availability may vary within reasonable disclosed limits. Material information must be accurate and not misleading. Mandatory declarations must be displayed where required.

6. Pricing and payments

Displayed prices and charges must be transparent. Taxes, delivery charges, platform fees and other mandatory charges should be disclosed before order confirmation. Payment processing may be performed by third-party payment providers under their terms. Bazako.com may correct manifest pricing or technical errors before fulfilment, subject to applicable law and customer rights.

7. Reviews and user content

Users must not submit fake, paid-without-disclosure, defamatory, infringing, unlawful or manipulated reviews/content. Bazako.com may moderate content under published rules and applicable law.

8. Intellectual property

Bazako.com's software, branding, text, graphics and original content are protected by applicable law. Sellers grant Bazako.com the limited licence needed to display and market their listings.

9. Suspension

Bazako.com may suspend listings/accounts for suspected fraud, unlawful products, repeated violations, security threats, IP complaints, regulatory requirements or material breach, using proportionate procedures where practicable.

10. Indemnity

To the maximum extent permitted by law, a seller/user may be required to indemnify and hold harmless the firm and its authorised personnel for losses arising from that party's breach, unlawful conduct, infringement, fraud, misrepresentation, unsafe goods or statutory non-compliance. This does not exclude liabilities that cannot legally be excluded.

11. Limitation and founder protection

To the maximum extent permitted by law, claims arising from marketplace services should be directed against the contracting firm rather than individual partners, employees or officers acting in their official capacity. Nothing in these Terms creates a personal guarantee by any partner or officer. Nothing here excludes liability for fraud, wilful misconduct or any liability that applicable law makes non-excludable.

12. Grievance

Consumer grievances will be handled through the designated grievance mechanism. The e-commerce grievance process should acknowledge complaints within the legally prescribed period and seek redress within the applicable statutory timeline.

13. Governing law

Indian law applies. Subject to mandatory consumer jurisdiction and other statutory rights, disputes may be subject to the competent courts/tribunals having jurisdiction over the firm's principal place of business or otherwise as required by law.

14. Compliance basis

Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020, as applicable. Legal Metrology Act, 2009 and applicable Packaged Commodities Rules. Food Safety and Standards Act and applicable FSSAI regulations/guidance for food products. BIS Act and applicable compulsory certification / Quality Control Orders where a product is covered. Information Technology Act, 2000 and applicable IT Rules, including the 2026 amendments where applicable. Digital Personal Data Protection Act, 2023 and Digital Personal Data Protection Rules, 2025, according to their phased commencement. CCPA guidelines/advisories on dark patterns, misleading advertisements/endorsements and environmental claims, where applicable.
